Revised bill to block Obamacare printed

A new bill replacing HB 59 was sent to print by the House State Affairs Committee today to enact a moratorium on implementation of Obamacare. The new bill relies upon both the Tenth Amendment and Judge Vinson’s decision in Florida v. U.S. in which the entire law was declared unconstitutional. Idaho’s Health Freedom Act from last year, which I was pleased to draft, was specifically cited by Judge Vinson to provide legal standing for the plaintiff states. While I was uncomfortable with the tenor and breadth of HB 59, I worked with the sponsors to include the court decision and other changes to create what I believe we all feel is a stronger bill to address the overreach by the Feds in this matter. The new bill is HB 117 and should be up soon in State Affairs for a public hearing.
